Automobile wrecks, workers' compensation injuries, slip and falls, and other personal injuries have a significant impact on the life of the injured person. Often, injured persons are unable to work due to the injury, which greatly impacts the family. Injuries can also persist for the life of injured person.
I have successfully pursued and settled many car wreck cases and workers' compensation cases without going to trial, including a products liability action in Federal Court.
If the insurance company does not offer a fair settlement, rest assured, I will vigorously advance the case to trial.
Choose wisely when hiring a probate attorney; it can well make the difference whether an estate is open for a few months or few years! In the past, I distributed a $2M+ estate, with 11 heirs, in as little as four months.
I can also help plan your Estate, before death. Failure to plan for death can cause major problems for loved ones left behind. Do not delay the drafting of a Will. If death occurs without a Will, not you, but the laws of the State of Tennessee determine how property is distributed.
It also wise to draft a Power of Attorney.
A DUI conviction can have a significant impact, including a jail sentence, fines, and loss of driving privileges - which often lead to job loss. An arrest for DUI does not mean a conviction. Procedures must be followed by the police and the arrest must comply with the Constitution, particularly the 4th Amendment, which prohibits "unreasonable searches and seizures." The moment the blue lights are turned on, a "seizure" occurs. An experienced attorney knows what to look for, and the questions to ask the officer, to make the argument the DUI arrest violates the Constitution and the case should be dismissed.
Being denied benefits can hurt - financially and emotionally. A person who works hard and pays into the Social Security system expects an efficient and quick process.
However, the Social Security Disability process is anything but quick, and is filled with technical rules.
An attorney skilled in trial advocacy, and a robust knowledge of the Social Security laws, is often the key to successfully obtaining benefits.
I served eight years as the Judge of the Family Court of Rhea County, TN.
Divorce is a major financial lawsuit - the court will divide your assets, and is supposed to do so "equitably"; however, under Tennessee law, an "equitable" division of assets does not necessarily mean an "equal" division.
Divorce is also a major emotional lawsuit when children are involved. Gone are the days when the court presumed a child of "tender years" belonged in the custody of the mother. The Court considers numerous factors in determining to whom custody of a child should be awarded.
I have participated as an attorney and judge in well over 1,000 divorce cases.
Choose an attorney knowledgeable and experienced in family law.
Insurance companies sometimes wrongfully deny fire and life insurance claims, or, alternatively, try to pay substantially less than the policy limits.
In Tennessee, bad faith failure to pay the claim can result in additional penalties assesed to the insurance company.
Tenn. Code Ann. 56-7-105 provides for a 25% "bad faith" penalty for failure to pay a legitimate insurance claim within 60 days after demand has been made by the holder of the policy.
We know that legal action can sometimes be overwhelming. We are dedicated to providing you help in language that you can understand. If you don't feel like you understand your options, just ask, and we will work to find an explanation that works for you.
The first step is for us to work with you and come up with a plan to get the results you need. Through our understanding of the law and your understanding of the circumstances, we will craft a path to success.
* Free consultation for personal injury, workers' compensation, Social Security Disability and other personal injury cases.
For other cases, a consultation fee is charged; however, if I am retained as an attorney, the consultation fee will be applied to the retainer fee, which will result in a free consultation as well.
